Dolores)<\/figcaption><\/figure>\n<p>O presidente do Tribunal de Justi\u00e7a do Maranh\u00e3o (TJMA), desembargador Antonio Guerreiro J\u00fanior, cassou a liminar do juiz da 5\u00aa Vara da Fazenda P\u00fablica de S\u00e3o Lu\u00eds, Jos\u00e9 Edilson Caridade Ribeiro, que, nos autos da A\u00e7\u00e3o Popular n\u00ba 56.417\/2013, suspendeu o procedimento de indica\u00e7\u00e3o do vice-governador Washington Oliveira (PT) \u00e0 vaga de conselheiro do Tribunal de Contas do Estado (TCE) do Maranh\u00e3o.<\/p>\n<p>Guerreiro J\u00fanior afirmou que a suspens\u00e3o da liminar foi deferida diante da demonstra\u00e7\u00e3o inequ\u00edvoca de que o cumprimento da decis\u00e3o constitui grave potencial ofensivo aos bens jur\u00eddicos protegidos pelo artigo 4\u00ba da Lei n\u00ba 8.437\/19992.<\/p>\n<p>Segundo o presidente do TJMA, a liminar deferida culmina em invas\u00e3o a esfera de atua\u00e7\u00e3o do Poder Legislativo, configurando-se, por tal motivo, les\u00e3o \u00e0 ordem, abalada ante a ofensa a um dos princ\u00edpios basilares da Carta Pol\u00edtica Federativa, que \u00e9 independ\u00eancia entre os Poderes.<\/p>\n<p>\u201cVerifico o risco de grave les\u00e3o \u00e0 ordem p\u00fablica, caso seja cumprido a liminar concedida pelo juiz de base, tendo em vista a indevida inger\u00eancia do Poder Judici\u00e1rio em mat\u00e9ria interna corporis do Poder Legislativo\u201d, frisou Guerreiro J\u00fanior.<\/p>\n<p>O desembargador ressaltou que houve total obedi\u00eancia \u00e0 tramita\u00e7\u00e3o legal do procedimento de indica\u00e7\u00e3o de Washington Oliveira ao cargo de conselheiro do Tribunal de Contas, cumprindo-se todas as normas da Constitui\u00e7\u00e3o Estadual e do Regimento Interno da Assembleia
