A 1\u00aa Turma do Tribunal Regional Federal da 1\u00aa Regi\u00e3o (TRF1) reformou a senten\u00e7a e concedeu o benef\u00edcio de aux\u00edlio-reclus\u00e3o ao filho de um segurado da Previd\u00eancia Social preso em regime fechado na Penitenci\u00e1ria Regional de Pedreiras\/MA, uma vez que no momento da pris\u00e3o ele estava desempregado e sem renda.<\/p>\n\n\n\n

Consta nos autos que o segurado se encontrava desempregado e sem fonte de renda desde o ano anterior \u00e0 pris\u00e3o, conforme o Cadastro Nacional de Informa\u00e7\u00f5es Sociais (CNIS), al\u00e9m de ter recebido seguro-desemprego, mantendo a sua qualidade de segurado por 24 meses nos termos do art. 15, II e \u00a7 2\u00ba, da Lei 8.213\/91. O autor, por interm\u00e9dio de sua av\u00f3 materna e guardi\u00e3, alegou cumprir todos os requisitos exigidos para a concess\u00e3o do benef\u00edcio, e o Minist\u00e9rio P\u00fablico Federal (MPF) manifestou-se pelo provimento da apela\u00e7\u00e3o.<\/p>\n\n\n\n

Ao analisar o caso, o relator, desembargador federal Gustavo Soares Amorim, destacou que, nos termos do art. 80 da Lei 8.213\/91 e do art. 116 do Decreto 3.048\/99, a concess\u00e3o do aux\u00edlio-reclus\u00e3o \u00e9 dada aos dependentes do segurado preso em regime fechado ou semiaberto desde que atendidos os requisitos de baixa renda, qualidade de segurado e depend\u00eancia econ\u00f4mica.<\/p>\n\n\n\n

Nesse sentido, o desembargador ressaltou o entendimento do Superior Tribunal de Justi\u00e7a (STJ) de que para a concess\u00e3o de aux\u00edlio-reclus\u00e3o, nos termos do art. 80 da Lei 8.213\/1991, no regime anterior \u00e0 vig\u00eancia da MP 871\/2019, a aferi\u00e7\u00e3o da renda do segurado que n\u00e3o exercia atividade laboral remunerada no momento do recolhimento deve considerar a aus\u00eancia de renda, e n\u00e3o o \u00faltimo sal\u00e1rio de contribui\u00e7\u00e3o.<\/p>\n\n\n\n

Assim, o relator concluiu que os dependentes do segurado t\u00eam direito ao aux\u00edlio-reclus\u00e3o em raz\u00e3o da comprova\u00e7\u00e3o de situa\u00e7\u00e3o de desemprego do preso no momento da pris\u00e3o.<\/p>\n\n\n\n
