Jackson promover 38 professores<\/b><\/font> <\/p>\n

O governo do Maranh\u00e3o ter\u00e1 que promover, este m\u00eas, 38 professores da rede estadual de ensino. As promo\u00e7\u00f5es funcionais foram determinadas pelo Tribunal de Justi\u00e7a do Maranh\u00e3o (TJMA) em atendimento a a\u00e7\u00f5es judiciais solicitadas pelo Sindicato dos Trabalhadores em Educa\u00e7\u00e3o P\u00fablica do Maranh\u00e3o (Sinproesemma). Como conseq\u00fc\u00eancia, esses profissionais mudar\u00e3o de classe passando para uma superior, conforme prev\u00eaem os artigos 40, 41 e 42 do Estatuto do Magist\u00e9rio Estadual (Lei 6.110\/94). O resultado ser\u00e1 a eleva\u00e7\u00e3o salarial.<\/p>\n

As a\u00e7\u00f5es judiciais foram necess\u00e1rios ap\u00f3s a via administrativa \u0096 isto \u00e9, o simples pedido ao administrador \u0096 n\u00e3o ter surtido efeito. Ficou decidido na tese que a promo\u00e7\u00e3o funcional \u00e9 legal e devida. O Tribunal de Justi\u00e7a do Maranh\u00e3o manteve as senten\u00e7as que foram julgadas neste sentido e inverteu as que inicialmente haviam sido julgadas improcedentes.<\/p>\n

Outra obriga\u00e7\u00e3o do Estado, fixada pelo TJMA, \u00e9 pagar as diferen\u00e7as decorrentes da data de ingresso do pedido administrativo at\u00e9 a da decis\u00e3o judicial. Neste caso, o pagamento dos retroativos ser\u00e1 feito de forma mais demorada, porque depende do precat\u00f3rio que est\u00e1 em tramita\u00e7\u00e3o. A previs\u00e3o para o pagamento \u00e9 2009.<\/p>\n

“Esta \u00e9 mais uma vit\u00f3ria da nossa categoria. Isso mostra que n\u00e3o devemos desistir da luta pelos nossos direitos. Pode demorar, mas o justo prevalece”, comemorou Odair Jos\u00e9, presidente do Sinproesemma que lembrou que, diferentemente do pagamento dos retroativos, as promo\u00e7\u00f5es t\u00eam que ser feitas imediatamente e j\u00e1 est\u00e3o em execu\u00e7\u00e3o.<\/p>\n

PROMO\u00c7\u00c3O<\/b><\/p>\n

Desde o governo Jos\u00e9 Reinaldo, o Estado vem retardando a efetiva\u00e7\u00e3o das promo\u00e7\u00f5es funcionais. At\u00e9 uma A\u00e7\u00e3o Direta de Inconstitucionalidade (Adin n\u00ba 3567) foi requerida ao Supremo Tribunal Federal (STF) pelo procurador-geral, Antonio Fernando Sousa. Ele pede a decreta\u00e7\u00e3o da ilegalidade de quatro artigos (40, 41, 42 e 54) da lei n\u00ba 6.110\/94 (Estatuto do Magist\u00e9rio), de um artigo da lei n\u00ba 7.885\/03 e de um artigo da lei n\u00ba 8.186\/04 sob o argumento de que ferem a Constitui\u00e7\u00e3o Federal. Os artigos tratam da promo\u00e7\u00e3o funcional na categoria e da defini\u00e7\u00e3o do sal\u00e1rio m\u00ednimo como vencimento-base, sobre o qual incide a Gratifica\u00e7\u00e3o por Atividade de Magist\u00e9rio (GAM).<\/p>\n
