A decis\u00e3o un\u00e2nime aconteceu na sess\u00e3o desta ter\u00e7a-feira, 18.<br \/>\n\u00a0<br \/>\nLeal \u00e9 acusado de improbidade administrativa no ano de 2005, por alugar uma p\u00e1 carregadeira no valor de R$20.914,00 sem licita\u00e7\u00e3o, al\u00e9m de n\u00e3o comprovar o pagamento do servi\u00e7o contratado, condutas previstas na Lei 8.666\/93.<br \/>\n\u00a0<br \/>\nA den\u00fancia oferecida pelo Minist\u00e9rio P\u00fablico Estadual (MPE) destaca ainda a desaprova\u00e7\u00e3o das contas do munic\u00edpio de Governador Archer pelo Tribunal de Contas do Estado (TCE).<\/p>\n<p>Em sua defesa pr\u00e9via, o denunciado alega que, \u00e0 \u00e9poca, a cidade estava em situa\u00e7\u00e3o de calamidade e precisava com urg\u00eancia de um mutir\u00e3o de limpeza, quando se fez necess\u00e1ria a contrata\u00e7\u00e3o de servi\u00e7os com dispensa de licita\u00e7\u00e3o.<\/p>\n<p>O relator do processo, desembargador Raimundo Melo, teve o seu voto acompanhado pelos desembargadores Bayma Ara\u00fajo (presidente da 1\u00aa C\u00e2mara Criminal) e Jos\u00e9 Luiz Almeida. O MPE tamb\u00e9m decidiu pelo afastamento.<\/p>\n<p><strong>Precat\u00f3rio<\/strong><\/p>\n<p>Na mesma sess\u00e3o, o desembargador Bayma tamb\u00e9m recebeu a den\u00fancia contra o prefeito de S\u00e3o Vicente de F\u00e9rrer, Jo\u00e3o Batista Freitas, por desobedecer a ordem judicial expedida pelo Tribunal de Justi\u00e7a para pagamento de precat\u00f3rio no valor R$92.772,53, com inclus\u00e3o no pr\u00f3ximo or\u00e7amento e atualiza\u00e7\u00e3o at\u00e9 a data do efetivo pagamento.
