O Partido Republicano Progressista (PRP) entrou hoje com a\u00e7\u00e3o de perda de mandato eletivo no Tribunal Superior Eleitoral (TSE) por infidelidade partid\u00e1ria contra o deputado federal\u00a0Juscelino Filho (MA). Eleito pelo PRP em 2014, o parlamentar\u00a0migrou sem justa causa para o rec\u00e9m-criado Partido da Mulher Brasileira (PMB). Os outros dois deputados federais da legenda, Marcelo \u00c1lvaro Ant\u00f4nio (MG)\u00a0e\u00a0Alexandre Valle (RJ), tamb\u00e9m foram acionados e, assim como Juscelino Filho, correm o risco de ficar sem mandato.<\/p>\n

O argumento central tem como base a data do registro do partido. Isso porque a minirreforma pol\u00edtica (Lei 13.165\/2015), em vigor desde 29 de setembro de 2015, n\u00e3o considera como justa causa a filia\u00e7\u00e3o em legendas rec\u00e9m-criadas, sem que o parlamentar perca o mandato. At\u00e9 ent\u00e3o, era permitido a ades\u00e3o a novas legendas sem o risco de ter o mandato cassado. Esta possibilidade constava da Resolu\u00e7\u00e3o\/TSE 22.610\/2007, que regulava as causas de infidelidade partid\u00e1ria at\u00e9 o advento da minirreforma.<\/p>\n

Liminar<\/strong><\/p>\n

O Supremo Tribunal Federal (STF), por sua vez, concedeu liminarmente pedido do Rede Solidariedade (SD) na ADI 5398, sob o fundamento de que o partido j\u00e1 havia obtido registro no TSE em 22 de setembro e o prazo jurisprudencial de 30 dias para receber mandat\u00e1rios estava em curso, tendo sido interrompido pela publica\u00e7\u00e3o da minirreforma. Ao analisar esta a\u00e7\u00e3o, o Ministro Lu\u00eds Roberto Barroso entendeu que partidos criados antes da publica\u00e7\u00e3o da nova lei e que j\u00e1 estivessem com prazo em curso n\u00e3o poderiam ser prejudicados. Ap\u00f3s esta decis\u00e3o, v\u00e1rios deputados federais, de v\u00e1rios partidos, migraram para o PMB.<\/p>\n

O PRP entende que esta liminar n\u00e3o se aplica ao PMB, uma vez que na data do deferimento de seu registro pelo TSE, a minirreforma j\u00e1 estava publicada e em vigor.
