{"id":3622,"date":"2012-02-02T22:01:05","date_gmt":"2012-02-03T00:01:05","guid":{"rendered":"https:\/\/www.blogsoestado.com\/danielmatos\/?p=3622"},"modified":"2012-02-02T22:01:05","modified_gmt":"2012-02-03T00:01:05","slug":"stf-mantem-competencia-do-cnj-para-investigar-magistrados","status":"publish","type":"post","link":"https:\/\/www.blogsoestado.com\/danielmatos\/stf-mantem-competencia-do-cnj-para-investigar-magistrados\/","title":{"rendered":"STF mant\u00e9m compet\u00eancia do CNJ para investigar magistrados"},"content":{"rendered":"<figure id=\"attachment_3623\" aria-describedby=\"caption-attachment-3623\" style=\"width: 640px\" class=\"wp-caption aligncenter\"><a rel=\"attachment wp-att-3623\" href=\"https:\/\/www.blogsoestado.com\/danielmatos\/2012\/02\/02\/stf-mantem-competencia-do-cnj-para-investigar-magistrados\/pleno-supremo\/\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-3623\" src=\"https:\/\/www.blogsoestado.com\/danielmatos\/files\/2012\/02\/pleno-supremo.jpg\" alt=\"\" width=\"640\" height=\"298\" \/><\/a><figcaption id=\"caption-attachment-3623\" class=\"wp-caption-text\">Pleno do Supremo Tribunal Federal manteve poderes do CNJ para investigar conduta de ju\u00edzes e desembargadores<\/figcaption><\/figure>\n<p>O Plen\u00e1rio do Supremo Tribunal Federal (STF) acaba de decidir, por 6 votos a 5, manter a compet\u00eancia concorrente do Conselho Nacional de Justi\u00e7a (CNJ) para investigar magistrados, prevista no artigo 12 da Resolu\u00e7\u00e3o 135\/2011, do CNJ.<\/p>\n<p>O dispositivo, que havia sido suspenso na decis\u00e3o liminar do relator da A\u00e7\u00e3o Direta de Inconstitucionalidade (ADI) 4638, ministro Marco Aur\u00e9lio, diz que &#8220;para os processos administrativos disciplinares e para a aplica\u00e7\u00e3o de quaisquer penalidades previstas em lei, \u00e9 competente o Tribunal a que perten\u00e7a ou esteja subordinado o magistrado, sem preju\u00edzo da atua\u00e7\u00e3o do Conselho Nacional de Justi\u00e7a&#8221;.<\/p>\n<p>A decis\u00e3o de manter a vig\u00eancia desse artigo foi tomada pelo STF na noite desta quinta-feira (2), no julgamento em que a Corte analisa a liminar concedida parcialmente na ADI 4638 pelo ministro Marco Aur\u00e9lio, no dia 19 de dezembro do ano passado. A a\u00e7\u00e3o foi ajuizada na Corte pela Associa\u00e7\u00e3o dos Magistrados Brasileiros (AMB), para contestar diversos dispositivos da resolu\u00e7\u00e3o.<\/p>\n<p>Votaram contra a decis\u00e3o cautelar do relator as ministras Rosa Weber e C\u00e1rmen L\u00facia e os ministros Dias Toffoli, Joaquim Barbosa, Ayres Britto e Gilmar Mendes.
