MPT-MA pede indeniza\u00e7\u00e3o e o cumprimento da legisla\u00e7\u00e3o trabalhista<\/span><\/h2>\n

\"\"O Minist\u00e9rio P\u00fablico do Trabalho (MPT-MA) ajuizou uma a\u00e7\u00e3o civil p\u00fablica (ACP) contra a Caixa Econ\u00f4mica Federal por motivo de jornada excessiva de trabalho em suas ag\u00eancias no Maranh\u00e3o. O \u00f3rg\u00e3o pede o pagamento de dano moral coletivo de R$ 5 milh\u00f5es pela les\u00e3o causada \u00e0 toda sociedade.<\/p>\n

Segundo as investiga\u00e7\u00f5es, os empregados eram obrigados a prorrogar as jornadas de trabalho, extrapolando o limite di\u00e1rio de duas horas extras. \u201cA an\u00e1lise das fitas de abertura e fechamento de caixa demonstrou que a jornada de trabalho efetivamente cumprida diverge dos dados constantes no extrato do controle de ponto eletr\u00f4nico, comprovando as irregularidades\u201d, explicou o procurador do Trabalho respons\u00e1vel pelo caso Marcos Duanne.<\/p>\n

Al\u00e9m de serem submetidos \u00e0 jornada excessiva, os banc\u00e1rios n\u00e3o recebiam o pagamento integral das horas extras trabalhadas, n\u00e3o tinham intervalo para alimenta\u00e7\u00e3o e n\u00e3o possu\u00edam anota\u00e7\u00e3o correta de suas jornadas de trabalho di\u00e1rio.<\/p>\n

Abrang\u00eancia<\/strong><\/p>\n

Al\u00e9m da Procuradoria do Trabalho de Caxias, as Procuradorias de Imperatriz e Bacabal tamb\u00e9m investigaram outras ag\u00eancias da Caixa. O procurador Marcos Duanne concluiu que as irregularidades eram as mesmas e decidiu pedir, na a\u00e7\u00e3o, que a abrang\u00eancia dela fosse estendida a todo territ\u00f3rio maranhense.<\/p>\n

O MPT-MA pede o cumprimento de diversas obriga\u00e7\u00f5es: proceder a correta anota\u00e7\u00e3o da jornada de trabalho; n\u00e3o exigir de forma habitual a prorroga\u00e7\u00e3o da jornada al\u00e9m do limite previsto em lei; promover a compensa\u00e7\u00e3o ou efetuar o pagamento das horas extras, incluir nos contracheques os respectivos valores pagos; e conceder intervalo para alimenta\u00e7\u00e3o. \u200b A multa di\u00e1ria pedida na a\u00e7\u00e3o \u00e9 de R$ 5 mil por obriga\u00e7\u00e3o descumprida e de R$ 1 mil por trabalhador encontrado em situa\u00e7\u00e3o irregular.<\/p>\n

Entenda o caso<\/strong><\/p>\n

O MPT j\u00e1 havia ajuizado uma a\u00e7\u00e3o civil p\u00fablica em 2013 contra a Caixa, no munic\u00edpio de Caxias, por conta da jornada excessiva de trabalho. Na \u00e9poca, o valor do dano moral coletivo pedido foi de R$ 500 mil. No entanto, como a abrang\u00eancia dessa nova a\u00e7\u00e3o envolve todo o Maranh\u00e3o, o valor pedido subiu para R$ 5 milh\u00f5es.<\/p>\n
