Vereadores Marcial Lima e C\u00e9zar Bombeiro foram os autores da a\u00e7\u00e3o popular<\/figcaption><\/figure><\/div>\n\n\n\n

Os vereadores Marcial Lima (PRTB) e Cezar Bombeiro (PSD) comemoram, nesta quarta-feira (17), uma decis\u00e3o do juiz Douglas de Melo Martins, titular da Vara de Interesses Difusos e Coletivos da capital, considerando ilegal a interdi\u00e7\u00e3o do terreno da Feirinha do Vinhais.<\/p>\n\n\n\n

De acordo com a senten\u00e7a, os comerciantes poder\u00e3o ocupar a \u00e1rea at\u00e9 o julgamento do m\u00e9rito. <\/p>\n\n\n\n

Desde o in\u00edcio deste m\u00eas, os feirantes vinham cobrando uma solu\u00e7\u00e3o por parte da Prefeitura de S\u00e3o Lu\u00eds, ap\u00f3s o empres\u00e1rio C\u00e9sar Roberto Botelho Ara\u00fajo, que se diz propriet\u00e1rio do im\u00f3vel, impedir a realiza\u00e7\u00e3o da Feirinha e colocar cont\u00eaineres no local. <\/p>\n\n\n\n

Para resolver o conflito, a C\u00e2mara Municipal de S\u00e3o Lu\u00eds resolveu instituir uma comiss\u00e3o visando buscar uma solu\u00e7\u00e3o para o caso. Na semana passada, o colegiado formado pelos vereadores Pav\u00e3o Filho (PDT), Marcial Lima (PRTB), Edson Gaguinho (Podemos), Genival Alves (PRTB) e Honorato Fernandes (PT) chegou a participar de audi\u00eancia na Vara de Interesses Difusos e Coletivos para saber do se existe ou existiu algum processo ou decis\u00e3o judicial sobre o caso.<\/p>\n\n\n\n

Como foi informado que o caso em quest\u00e3o n\u00e3o havia sido judicializado, o colegiado composto pelos parlamentares, ent\u00e3o, resolveu impetrar uma A\u00e7\u00e3o Popular requerendo tutela de urg\u00eancia no sentido de que seja determinada a retirada dos cont\u00eaineres que impedem o acesso ao espa\u00e7o da feira livre at\u00e9 o julgamento final do m\u00e9rito. O documento protocolado pelos vereadores Marcial Lima e C\u00e9zar Bombeiro foi assinado pelo advogado Jos\u00e9 Luiz Chaves de Assun\u00e7\u00e3o, assessor jur\u00eddico do primeiro.<\/p>\n\n\n\n

No despacho, publicado nesta ter\u00e7a-feira (16), o juiz Douglas Martins deferiu o pedido, deu um prazo de cinco dias para a retirada dos cont\u00eaineres do local e fixou multa di\u00e1ria de R$ 5 mil em caso de descumprimento.<\/p>\n\n\n\n

“Defiro o pedido de tutela de urg\u00eancia formulado e, por conseguinte, determino a C\u00e9sar Roberto Botelho Ara\u00fajo que, no prazo de 5 dias, retire os cont\u00eaineres do local em que ocorria a Feirinha do Vinhais e se abstenha de ocupar a \u00e1rea, at\u00e9 decis\u00e3o de m\u00e9rito”, diz trecho do documento. <\/p>\n\n\n\n

Papel da C\u00e2mara<\/strong><\/p>\n\n\n\n

Em entrevista ao programa C\u00e2mara em Destaque, o vereador C\u00e9zar Bombeiro considerou que se trata de uma decis\u00e3o importante para os feirantes e para a comunidade em geral. “A discuss\u00e3o judicial acabou sendo boa porque reconheceu a necessidade de analisar o caso por meio da Justi\u00e7a. Agora \u00e9 aguardar o julgamento do m\u00e9rito”, opinou.<\/p>\n\n\n\n

Por sua vez, o vereador Marcial Lima destacou o importante papel da C\u00e2mara na resolu\u00e7\u00e3o do conflito e revelou que est\u00e1 esperan\u00e7oso em rela\u00e7\u00e3o ao julgamento final do m\u00e9rito. ” Essa \u00e9 uma decis\u00e3o muito importante. \u00c9 um marco, pois n\u00e3o existia um processo sobre o caso tramitando na justi\u00e7a, mas n\u00f3s, por meio da C\u00e2mara, resolvemos ingressar com uma A\u00e7\u00e3o Popular. Reconhe\u00e7o o esfor\u00e7o desta Casa em buscar meios poss\u00edveis para solucionar o conflito”, afirmou.<\/p>\n\n\n\n

Audi\u00eancia<\/strong><\/p>\n\n\n\n

Em sua decis\u00e3o, o magistrado pediu que a determina\u00e7\u00e3o fosse cumprida com urg\u00eancia, se necess\u00e1rio em raz\u00e3o do feriado, por Oficial de Justi\u00e7a Plantonista e designou o dia 24 de julho, \u00e0s 9h, para realiza\u00e7\u00e3o de audi\u00eancia de concilia\u00e7\u00e3o.
