INDIGNA\u00c7\u00c3O – \u2002Ad\u00e9lio: a decis\u00e3o da Justi\u00e7a de declar\u00e1-lo inimput\u00e1vel aborreceu o presidente (Ricardo Moraes\/Reuters) <\/figcaption><\/figure><\/div>\n\n\n\nO juiz federal Bruno Savino, da 3\u00aa Vara da Justi\u00e7a Federal em Juiz de Fora, absolveu nesta sexta-feira, 14, o gar\u00e7om Ad\u00e9lio Bispo de Oliveira, considerado inimput\u00e1vel no processo em que \u00e9 acusado de esfaquear o presidente Jair Bolsonaro, em julho de 2018. Ao absolver Ad\u00e9lio \u201cimpropriamente\u201d, isto \u00e9, considerando que h\u00e1 elementos para a condena\u00e7\u00e3o, mas que a inimputabilidade por transtornos mentais demanda medidas alternativas, o magistrado determinou que ele seja internado.<\/p>\n\n\n\n
\u201cPelo exposto, em raz\u00e3o da inimputabilidade do r\u00e9u ao tempo do fato, absolvo impropriamente Ad\u00e9lio Bispo de Oliveira, nos termos do art. 386, VI, do C\u00f3digo de Processo Penal. Pela imputa\u00e7\u00e3o do delito previsto no art. 20, par\u00e1grafo \u00fanico, primeira parte, da Lei n\u00b0 7.1 70\/83, aplico medida de seguran\u00e7a de interna\u00e7\u00e3o (art. 96, l, do CP e art. 386, par\u00e1grafo \u00fanico, III, do CPP), por tempo indeterminado, enquanto n\u00e3o for verificada a cessa\u00e7\u00e3o da periculosidade, o que deve ser constatado por meio de per\u00edcia m\u00e9dica, na forma do art. 97, \u00a72\u00b0, do CP, ao fim do prazo m\u00ednimo, que fixo em tr\u00eas anos em raz\u00e3o das circunst\u00e2ncias do atentado e da alt\u00edssima periculosidade do r\u00e9u. Converto a pris\u00e3o preventiva em medida cautelor de interna\u00e7\u00e3o provis\u00f3ria. Determino que o r\u00e9u seja mantido custodiado na Penitenci\u00e1ria Federal de Seguran\u00e7a M\u00e1xima de Campo Grande\/MS\u201d, diz a decis\u00e3o do juiz.<\/p>\n","protected":false},"excerpt":{"rendered":"
