O relator da a\u00e7\u00e3o \u00e9 o ministro Luiz Fux.<\/p>\n\n\n\n<p>Dodge argumenta que, em raz\u00e3o do car\u00e1ter unit\u00e1rio da magistratura judicial brasileira, a movimenta\u00e7\u00e3o na carreira (promo\u00e7\u00e3o, remo\u00e7\u00e3o e permuta) envolve interesse de todos os magistrados, obrigando que a mat\u00e9ria seja tratada de maneira uniforme por lei complementar nacional, de iniciativa do STF. At\u00e9 a edi\u00e7\u00e3o do Estatuto da Magistratura, observa a procuradora-geral, o STF tem entendido que a mat\u00e9ria ser\u00e1 disciplinada pela Lei Complementar 35\/1979 (Lei Org\u00e2nica da Magistratura &#8211; Loman).<\/p>\n\n\n\n<p>Para a autora da ADI, ao admitir uma esp\u00e9cie de \u201cpromo\u00e7\u00e3o virtual\u201d (promo\u00e7\u00e3o seguida de remo\u00e7\u00e3o para a mesma comarca na qual atua o magistrado), a lei maranhense criou uma forma de remo\u00e7\u00e3o an\u00f4mala autom\u00e1tica n\u00e3o prevista na Constitui\u00e7\u00e3o Federal nem na Loman.<\/p>\n\n\n\n<p>Ela aponta que a regra, inclu\u00edda no C\u00f3digo de Divis\u00e3o e Organiza\u00e7\u00e3o Judici\u00e1rias do Estado do Maranh\u00e3o pela Lei Complementar 188\/2017, desrespeitou crit\u00e9rios m\u00ednimos de promo\u00e7\u00e3o e remo\u00e7\u00e3o previstos na legisla\u00e7\u00e3o nacional, usurpando a iniciativa privativa do Supremo e a compet\u00eancia legislativa da Uni\u00e3o.<\/p>\n\n\n\n<p>Ainda segundo a procuradora, a \u201cpromo\u00e7\u00e3o virtual\u201d cria forma an\u00f4mala de movimenta\u00e7\u00e3o da carreira (remo\u00e7\u00e3o por op\u00e7\u00e3o ap\u00f3s promo\u00e7\u00e3o), sem abertura pr\u00e9via de concurso de promo\u00e7\u00e3o ou remo\u00e7\u00e3o e sem observ\u00e2ncia do crit\u00e9rio de altern\u00e2ncia (merecimento e antiguidade).
