{"id":70162,"date":"2020-02-11T14:15:24","date_gmt":"2020-02-11T17:15:24","guid":{"rendered":"https:\/\/www.blogsoestado.com\/danielmatos\/?p=70162"},"modified":"2020-02-11T14:15:24","modified_gmt":"2020-02-11T17:15:24","slug":"mp-eleitoral-no-maranhao-estabelece-diretrizes-para-inibir-a-propaganda-eleitoral-antecipada-em-2020","status":"publish","type":"post","link":"https:\/\/www.blogsoestado.com\/danielmatos\/mp-eleitoral-no-maranhao-estabelece-diretrizes-para-inibir-a-propaganda-eleitoral-antecipada-em-2020\/","title":{"rendered":"MP Eleitoral no Maranh\u00e3o estabelece diretrizes para inibir a propaganda eleitoral antecipada em 2020"},"content":{"rendered":"\n<p class=\"has-text-color has-large-font-size has-vivid-red-color\">Uso de outdoors \u00e9 proibido na pr\u00e9-campanha e no per\u00edodo regular de campanha<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright size-large\"><img decoding=\"async\" src=\"https:\/\/www.blogsoestado.com\/danielmatos\/files\/2020\/02\/pre-campanha.jpg\" alt=\"\" class=\"wp-image-70163\"\/><\/figure><\/div>\n\n\n\n<p>O Minist\u00e9rio P\u00fablico (MP) Eleitoral no Maranh\u00e3o expediu, na manh\u00e3 desta segunda-feira (10), uma instru\u00e7\u00e3o destinada \u00e0s Promotorias Eleitorais do estado referente ao per\u00edodo eleitoral do ano de 2020, sobre a proibi\u00e7\u00e3o de meios de publicidade na pr\u00e9-campanha eleitoral j\u00e1 vedados na campanha eleitoral regular.<\/p>\n\n\n\n<p>De in\u00edcio, a recomenda\u00e7\u00e3o cita que a propaganda eleitoral \u00e9 vedada antes do dia 16 de agosto, de acordo com os termos do art. 36 da Lei n\u00ba 9.504\/1997. No entanto, os debates entre candidatos podem ocorrer antes do in\u00edcio das campanhas, por ser vantajoso aos eleitores o conhecimento pr\u00e9vio das inten\u00e7\u00f5es e propostas de cada um. A propaganda eleitoral consiste na divulga\u00e7\u00e3o de plataformas, programas de governo, qualidades pessoais e profissionais do candidato, tendo como finalidade a obten\u00e7\u00e3o do voto do eleitor.<\/p>\n\n\n\n<p>Al\u00e9m disso, com base na Lei das Elei\u00e7\u00f5es, a qual pro\u00edbe o uso de meios de publicidade em alguns dispositivos no per\u00edodo de propaganda eleitoral oficial e, consequentemente, na fase anterior, o Tribunal Superior Eleitoral (TSE) decidiu pela proibi\u00e7\u00e3o do uso de outdoors e veicula\u00e7\u00e3o de propaganda em bens p\u00fablicos e de uso comum nos atos de pr\u00e9-campanha e na divulga\u00e7\u00e3o de atos parlamentares, mesmo que n\u00e3o haja pedido expl\u00edcito de voto, em julgamento do recurso especial 0600337-30.2018.<\/p>\n\n\n\n<p>Dessa forma, segundo o Procurador Regional Eleitoral no Maranh\u00e3o, Juraci Guimar\u00e3es J\u00fanior, \u00e9 preciso que haja compatibilidade e coer\u00eancia entre os meios utilizados na pr\u00e9-campanha eleitoral e os autorizados na propaganda eleitoral permitida. Assim, a instru\u00e7\u00e3o orienta os Promotores Eleitorais a tomarem medidas, em caso de hip\u00f3tese de viola\u00e7\u00e3o, como a imediata cessa\u00e7\u00e3o da propaganda il\u00edcita por meio do poder de pol\u00edcia do juiz eleitoral; ajuizar representa\u00e7\u00e3o por propaganda eleitoral antecipada para cessa\u00e7\u00e3o da conduta e aplica\u00e7\u00e3o de multa, al\u00e9m de considerar A\u00e7\u00e3o de Investiga\u00e7\u00e3o Judicial Eleitoral por abuso de poder econ\u00f4mico.<\/p>\n\n\n\n<p>Ainda de acordo com o Procurador, \u201ca Procuradoria Regional Eleitoral (PRE) constatou, nas principais cidades do estado, o uso de propaganda eleitoral antecipada em outdoors por pr\u00e9-candidatos parlamentares sob o pretexto de divulga\u00e7\u00e3o de sua atividade parlamentar. Por\u00e9m, a principal finalidade n\u00e3o \u00e9 divulgar esta atividade, mas no per\u00edodo proibido realizar n\u00edtida propaganda eleitoral antecipada, o que demanda repress\u00e3o pelo Minist\u00e9rio P\u00fablico Eleitoral.
