{"id":76014,"date":"2020-08-10T22:33:18","date_gmt":"2020-08-11T01:33:18","guid":{"rendered":"https:\/\/www.blogsoestado.com\/danielmatos\/?p=76014"},"modified":"2020-08-10T22:33:18","modified_gmt":"2020-08-11T01:33:18","slug":"pgr-questiona-no-stf-foro-especial-a-delegados-procuradores-defensores-e-auditores-no-maranhao","status":"publish","type":"post","link":"https:\/\/www.blogsoestado.com\/danielmatos\/pgr-questiona-no-stf-foro-especial-a-delegados-procuradores-defensores-e-auditores-no-maranhao\/","title":{"rendered":"PGR questiona no STF foro especial a delegados, procuradores, defensores e auditores no Maranh\u00e3o"},"content":{"rendered":"\n<p class=\"has-text-color has-huge-font-size has-vivid-red-color\">Nas ADIs, Augusto Aras alega que leis violam a Constitui\u00e7\u00e3o Federal, que prev\u00ea que esses agentes p\u00fablicos sejam processados e julgados na Justi\u00e7a de primeiro grau  <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft size-large\"><img decoding=\"async\" src=\"https:\/\/www.blogsoestado.com\/danielmatos\/files\/2020\/08\/aras.jpg\" alt=\"\" class=\"wp-image-76015\"\/><figcaption>Procurador-geral Augusto Aras  <\/figcaption><\/figure><\/div>\n\n\n\n<p>O procurador-geral da Rep\u00fablica, Augusto Aras, ajuizou no Supremo Tribunal Federal (STF) 17 a\u00e7\u00f5es diretas de inconstitucionalidade (ADIs) contra dispositivos das Constitui\u00e7\u00f5es estaduais do Maranh\u00e3o e de outras 16 unidades da federa\u00e7\u00e3o que atribuem foro por prerrogativa de fun\u00e7\u00e3o a autoridades que n\u00e3o s\u00e3o listadas na Constitui\u00e7\u00e3o Federal, como defensores p\u00fablicos, delegados, procuradores, auditores militares, presidentes de entidades estaduais e reitores.<br><br>Aras argumenta que a Constitui\u00e7\u00e3o estabelece o foro especial para presidente e o vice-presidente da Rep\u00fablica, deputados federais e senadores, ministros do STF, dos tribunais superiores e do Tribunal de Contas da Uni\u00e3o (TCU), procurador-geral da Rep\u00fablica, ministros de Estado, advogado-geral da Uni\u00e3o, comandantes da Marinha, do Ex\u00e9rcito e da Aeron\u00e1utica, chefes de miss\u00e3o diplom\u00e1tica de car\u00e1ter permanente, governadores, magistrados, conselheiros dos Tribunais de Contas, membros do Minist\u00e9rio P\u00fablico e prefeitos. Essas autoridades s\u00e3o a refer\u00eancia para que as constitui\u00e7\u00f5es estaduais indiquem os seus equivalentes.<\/p>\n\n\n\n<p>Segundo o procurador-geral, os estados n\u00e3o podem inovar nessa \u00e1rea, pois a Uni\u00e3o tem a compet\u00eancia exclusiva para legislar sobre Direito Processual.
