O ministro relator Francisco Falc\u00e3o deu provimento a um recurso interposto pelo Estado do Maranh\u00e3o contra uma decis\u00e3o local que limpou a ficha do pol\u00edtico e o tornou novamente ineleg\u00edvel.<\/p>\n\n\n\n<p>A corte superior acatou recurso especial da Procuradoria Geral do Estado (PGE) que pleiteou que fosse levado em considera\u00e7\u00e3o ac\u00f3rd\u00e3o do Tribunal de Contas do Estado do Maranh\u00e3o (TCE-MA) que condenou Julinho por irrelaridades financeiras no exerc\u00edcio do cargo diretor da Maternidade Benedito Leite, vinculada \u00e0 rede estadual de sa\u00fade.<\/p>\n\n\n\n<p>O m\u00e9dico havia obtido ganho de causa na Justi\u00e7a maranhense ao alegar que n\u00e3o recebeu a notifica\u00e7\u00e3o referente \u00e0 sua condena\u00e7\u00e3o no processo julgado pelo TCE-MA. Por outro lado, o ministro relator manifestou entendimento diferente, uma vez que nos autos consta a informa\u00e7\u00e3o de que uma funcion\u00e1ria da casa da ex-esposa de Julinho recebeu a cita\u00e7\u00e3o no referido endere\u00e7o e assinou o documento, comprovando a entrega.<\/p>\n\n\n\n<p>Francisco Falc\u00e3o reconheceu a validade da notifica\u00e7\u00e3o, acatando os argumentos da PGE de que a mesma foi recebida, por via postal, no endere\u00e7o fornecido pelo pr\u00f3prio Julinho, situa\u00e7\u00e3o amparada pela Constitui\u00e7\u00e3o Federal e j\u00e1 julgada procedente por
