alt=\"\" class=\"wp-image-83441\"\/><\/a><\/figure><\/div>\n\n\n\n<p>O juiz Anderson Sobral de Azevedo, auxiliar da Comarca da Ilha de S\u00e3o Lu\u00eds, respondendo pela Vara de Interesses Difusos e Coletivos, indeferiu o pedido de ado\u00e7\u00e3o de medidas mais restritivas de contato social para todo o estado do Maranh\u00e3o, pleiteado na A\u00e7\u00e3o Civil ajuizada pela Defensoria P\u00fablica do Estado do Maranh\u00e3o. &nbsp;<\/p>\n\n\n\n<p>Na decis\u00e3o, prolatada na manh\u00e3 desta segunda-feira (8), o magistrado esclarece que indeferiu o pedido liminar por falta de um dos seus pressupostos, qual seja, a plausibilidade do direito invocado (fumus boni juris), nos termos do art. 12, da Lei n\u00ba 7.347\/1985, &#8220;pois n\u00e3o encontrou ilegalidade, seja por a\u00e7\u00e3o ou omiss\u00e3o, nas medidas adotadas at\u00e9 o presente momento pelo Governo do Estado e pelos governos municipais&#8221;.<\/p>\n\n\n\n<p><strong>Desmembramento<\/strong><\/p>\n\n\n\n<p>Al\u00e9m disso, determinou o desmembramento do litiscons\u00f3rcio multitudin\u00e1rio existente na peti\u00e7\u00e3o inicial para restringir a perman\u00eancia no polo passivo da A\u00e7\u00e3o Civil P\u00fablica apenas ao Estado do Maranh\u00e3o e munic\u00edpios de S\u00e3o Lu\u00eds, Pa\u00e7o do Lumiar, S\u00e3o Jos\u00e9 de Ribamar e Raposa.<\/p>\n\n\n\n<p>Em respeito ao princ\u00edpio da compet\u00eancia adequada nos processos coletivos, o juiz Anderson Sobral determinou que o ajuizamento de novas a\u00e7\u00f5es em face dos demais munic\u00edpios do estado dever\u00e1 ser realizado perante as respectivas comarcas.<\/p>\n\n\n\n<p>Determinou, ainda, que a Secretaria Judicial proceda \u00e0s mudan\u00e7as necess\u00e1rias para corre\u00e7\u00e3o da autua\u00e7\u00e3o eletr\u00f4nica do processo, levando em considera\u00e7\u00e3o a limita\u00e7\u00e3o do litiscons\u00f3rcio multitudin\u00e1rio.&nbsp; Ao final, determinou a cita\u00e7\u00e3o do Estado do Maranh\u00e3o e munic\u00edpios de S\u00e3o Lu\u00eds, Pa\u00e7o do Lumiar, S\u00e3o Jos\u00e9 de Ribamar e Raposa para
