O DEM apresentou, ainda, uma consulta questionando se atos de inaugura\u00e7\u00e3o de obras e programas governamentais podem ser considerados propaganda eleitoral antecipada.<br \/>\n\u00a0<br \/>\n<strong>Representa\u00e7\u00e3o<\/strong><\/p>\n<p>Segundo o deputado federal Roberto Magalh\u00e3es (DEM-PE), a reuni\u00e3o de prefeitos realizada em Bras\u00edlia na \u00faltima semana, que reuniu cerca de cinco mil chefes de executivo municipais, teria se caracterizado como t\u00edpico ato de campanha. \u201cMesmo que n\u00e3o haja refer\u00eancia expressa \u00e0 candidatura da ministra-chefe da Casa Civil Dilma Roussef, n\u00e3o se pode olvidar que eventos como o ocorrido em Bras\u00edlia nos dias 10 e 11 de fevereiro conseguem levar ao conhecimento de todos o nome de um agente p\u00fablico que, se depender da vontade do presidente da Rep\u00fablica, ser\u00e1 oficialmente anunciada como candidata \u00e0 sucess\u00e3o presidencial\u201d, diz a representa\u00e7\u00e3o.<\/p>\n<p>Para o deputado, existe respaldo na jurisprud\u00eancia dos Tribunais no sentido de que esse tipo de comportamento n\u00e3o \u00e9 legal.\u201cSe por acaso for legitimada pelos Tribunais esse tipo de campanha extempor\u00e2nea, ent\u00e3o \u00e9 melhor que a ministra seja candidata \u00fanica, porque n\u00e3o h\u00e1 oposi\u00e7\u00e3o, n\u00e3o h\u00e1 partido que possa enfrentar a m\u00e1quina do governo, com a presen\u00e7a de um presidente bem avaliado, durante dois anos nas televis\u00f5es, nas ruas e nas pra\u00e7as, nas inaugura\u00e7\u00f5es, preenchendo todo o espa\u00e7o que a oposi\u00e7\u00e3o n\u00e3o poderia preencher porque n\u00e3o tem a m\u00e1quina do governo\u201d, concluiu.<\/p>\n<p>Os partidos pedem a aplica\u00e7\u00e3o de multa ao presidente Lula, como art\u00edfice da conduta, e \u00e0 ministra Dilma Roussef, como benefici\u00e1ria. Conforme o artigo 36, par\u00e1grafo 3\u00ba, da Lei Eleitoral o valor da multa correspondente a R$ 53,2 mil. DEM e PSDB pedem ainda que os autos sejam encaminhados para o Minist\u00e9rio P\u00fablico Eleitoral, para as provid\u00eancias previstas em lei.<\/p>\n<p>Quem vai analisar a representa\u00e7\u00e3o \u00e9 o ministro Arnaldo Versiani.<br \/>\n\u00a0<br \/>\n<strong>Consulta<\/strong><\/p>\n<p>O assunto da consulta tamb\u00e9m \u00e9 propaganda eleitoral.
