A senten\u00e7a obriga a implanta\u00e7\u00e3o de medidas capazes de controlar a explora\u00e7\u00e3o da atividade comercial de estacionamento rotativo em \u00e1rea de preserva\u00e7\u00e3o hist\u00f3rica.<\/p>\n\n\n\n<p>De acordo com avalia\u00e7\u00e3o do Instituto do Patrim\u00f4nio Hist\u00f3rico e Art\u00edstico Nacional (Iphan), encaminhada ao MPF, a implanta\u00e7\u00e3o descontrolada de estacionamentos rotativos em casar\u00f5es e im\u00f3veis tombados causa danos \u00e0 integridade arquitet\u00f4nica e hist\u00f3rica dos im\u00f3veis, prejudicando principalmente a autenticidade do Centro Hist\u00f3rico da capital maranhense. Verificou-se que muitos im\u00f3veis foram parcialmente demolidos ou significativamente alterados. Houve a derrubada de paredes internas, alargamento de v\u00e3os das portas e outras modifica\u00e7\u00f5es de fachadas dos casar\u00f5es.<\/p>\n\n\n\n<p>Mesmo sendo respons\u00e1vel pelo controle do funcionamento desses estabelecimentos, o Munic\u00edpio de S\u00e3o Lu\u00eds tem tolerado a opera\u00e7\u00e3o irregular de tal atividade no Centro Hist\u00f3rico de S\u00e3o Lu\u00eds, uma vez que concede alvar\u00e1s sem qualquer ressalvas. Al\u00e9m disso, o munic\u00edpio elaborou anteriormente um plano de mobilidade na regi\u00e3o Central, com recursos da Uni\u00e3o, que n\u00e3o foi implementado.<\/p>\n\n\n\n<p><strong>Levantamento<\/strong><\/p>\n\n\n\n<p>Em vista disso, a Justi\u00e7a Federal determinou que o Munic\u00edpio de S\u00e3o Lu\u00eds realize, a partir das informa\u00e7\u00f5es t\u00e9cnicas j\u00e1 apresentadas pelo Iphan, um levantamento para identificar todos os estabelecimentos que promovam a explora\u00e7\u00e3o da atividade comercial de estacionamento rotativo na Zona de Preserva\u00e7\u00e3o Hist\u00f3rica, especialmente na \u00e1rea de tombamento federal, no prazo de 30 dias.<\/p>\n\n\n\n<p>Tamb\u00e9m foi determinado que, ap\u00f3s a conclus\u00e3o do levantamento, haja o cumprimento do\u00a0poder de pol\u00edcia sobre esses estabelecimentos, inclusive mediante interdi\u00e7\u00e3o de atividade irregular, entre outras medidas cab\u00edveis, em rela\u00e7\u00e3o aos empreendimentos que funcionem sem autoriza\u00e7\u00e3o da autoridade federal ou estadual do patrim\u00f4nio hist\u00f3rico, conforme os limites da \u00e1rea de tombamento.<\/p>\n\n\n\n<p><strong>Controle<\/strong><\/p>\n\n\n\n<p>Por fim, o Munic\u00edpio de S\u00e3o Lu\u00eds dever\u00e1 promover a implanta\u00e7\u00e3o das medidas de controle de estacionamento e circula\u00e7\u00e3o de ve\u00edculos no Centro Hist\u00f3rico, conforme a previs\u00e3o contida no Plano Diretor de Acessibilidade e Mobilidade da \u00c1rea Central de S\u00e3o
