O prefeito de Pau D\u2019arco do Piau\u00ed, F\u00e1bio Soares Ces\u00e1rio, protocolou no Tribunal Superior Eleitoral (TSE) a\u00e7\u00e3o cautelar pedindo que seja concedido efeito suspensivo ao recurso que apresentou no Supremo Tribunal Federal contra decis\u00e3o que cassou seu mandato. Para o TSE, o fato de F\u00e1bio Ces\u00e1rio ostentar a condi\u00e7\u00e3o de \u201cfilho de cria\u00e7\u00e3o\u201d do ex-prefeito torn\u00e1-lo-ia ineleg\u00edvel e, portanto, teria\u00a0de deixar a prefeitura.<\/p>\n

Na a\u00e7\u00e3o, o requerente alega que \u201da norma constitucional, quando trata de inelegibilidade por parentesco, decorrente de ado\u00e7\u00e3o, exige a formaliza\u00e7\u00e3o efetivada e n\u00e3o de fato, n\u00e3o havendo previs\u00e3o para a situa\u00e7\u00e3o do chamado \u2019filho de cria\u00e7\u00e3o\u2019\u201d.<\/p>\n

F\u00e1bio Soares afirma tamb\u00e9m que \u201da pr\u00f3pria Constitui\u00e7\u00e3o Federal, no artigo 227, par\u00e1grafo 5\u00ba, determina a necessidade de estrito cumprimento aos requisitos legais para a concretiza\u00e7\u00e3o da situa\u00e7\u00e3o de filho adotivo\u201d.<\/p>\n

O prefeito cita ainda a resposta a uma consulta feita ao Tribunal Regional Eleitoral do Piau\u00ed (TRE-PI), segundo a qual \u201da veda\u00e7\u00e3o constitucional do par\u00e1grafo s\u00e9timo da Constitui\u00e7\u00e3o Federal \u00e9 apenas para filhos adotivos legalmente, o que n\u00e3o corresponde ao caso apresentado, que \u00e9 de um filho registrado pelo pai biol\u00f3gico e que apenas foi criado por outro sem qualquer formalidade legal de ado\u00e7\u00e3o.\u201d<\/p>\n

Dessa forma, F\u00e1bio Ces\u00e1rio pede que o TSE suspenda os efeitos da decis\u00e3o que cassou seu diploma at\u00e9 que o Supremo julgue seu recurso, mantendo assim sua perman\u00eancia na chefia da prefeitura.<\/p>\n

Entenda o caso<\/strong><\/p>\n

O Plen\u00e1rio do\u00a0TSE considerou, na sess\u00e3o plen\u00e1ria de 15 de fevereiro de 2011,\u00a0F\u00e1bio Soares Ces\u00e1rio ineleg\u00edvel para o cargo de prefeito da cidade piauiense\u00a0por ser parente socioafetivo (filho de cria\u00e7\u00e3o) de Expedito Sind\u00f4, ex-prefeito do munic\u00edpio. Por maioria de votos, os ministros do TSE entenderam que a rela\u00e7\u00e3o socioafetiva de F\u00e1bio Ces\u00e1rio com o ex-prefeito \u00e9 evidente, j\u00e1 que \u00e9 conhecido na cidade como J\u00fanior Sind\u00f4, sendo inclusive apresentado como \u201cfilho\u201d por Expedito Sind\u00f4 em calend\u00e1rios que este distribuiu \u00e0 popula\u00e7\u00e3o.<\/p>\n

\u201cEmbora o v\u00ednculo filial entre o prefeito e o ex-prefeito n\u00e3o seja formal, os autos do processo demonstram a paternidade socioafetiva e que h\u00e1, no caso, uma ado\u00e7\u00e3o de fato\u201d, afirmou o ministro Arnaldo Versiani, relator do caso, na ocasi\u00e3o.<\/p>\n

O presidente do TSE salientou inclusive que, pelo conte\u00fado dos autos, o prefeito era conhecido na comunidade como J\u00fanior Sind\u00f4 e como \u201cfilho\u201d do ent\u00e3o prefeito do munic\u00edpio, Expedito Sind\u00f4, sendo assim apresentado \u00e0 popula\u00e7\u00e3o em calend\u00e1rios de felicita\u00e7\u00f5es distribu\u00eddos no munic\u00edpio.
