align=\"JUSTIFY\">Dentre as propostas de reforma pol\u00edtica em discuss\u00e3o no Congresso nacional, merece destaque a PEC n\u00ba 226\/2016, de autoria do deputado Federal Rubens J\u00fanior, propondo a ado\u00e7\u00e3o do instituto da revoga\u00e7\u00e3o popular de mandatos eletivos (voto destituinte), ou <i>recall<\/i>, como o denominam os norte-americanos, a fim de garantir o respeito \u00e0 soberania do povo, titular supremo e fonte de todo o poder. \u00c9 a possibilidade de cassa\u00e7\u00e3o do eleito diretamente pelos cidad\u00e3os-eleitores.<\/p>\n<p align=\"JUSTIFY\">A ess\u00eancia do instituto consiste na supress\u00e3o do mandato do governante que n\u00e3o cumprir fielmente os compromissos assumidos durante a campanha eleitoral ou perder a confian\u00e7a popular em virtude de sua atua\u00e7\u00e3o contr\u00e1ria ao interesse p\u00fablico.<\/p>\n<p align=\"JUSTIFY\">De acordo com a proposta, ap\u00f3s <span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">um ano da posse do <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">p<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">residente da Rep\u00fablica, dos <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">g<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">overnadores de Estado e dos <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">p<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">refeitos <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">m<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">unicipais, estes poder\u00e3o ter o seu mandato revogado mediante expressa autoriza\u00e7\u00e3o da C\u00e2mara dos Deputados e pela soberana decis\u00e3o dos eleitores em consulta popular. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Se o resultado da consulta popular for favor\u00e1vel <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">\u00e0<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"> revoga\u00e7\u00e3o do mandato, o afastamento do <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">c<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">hefe do Executivo se dar\u00e1 imediatamente ap\u00f3s a homologa\u00e7\u00e3o do resultado pelo \u00f3rg\u00e3o competente <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">da Justi\u00e7a Eleitoral<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">. <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Caso o <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">resultado da consulta popular seja contr<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">\u00e1ria \u00e0 revoga\u00e7\u00e3o do mandato eletivo em quest\u00e3o, n\u00e3o poder\u00e1 ser <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">convocada uma <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">nova, at\u00e9 o final do respectivo mandato. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Na justifica\u00e7\u00e3o da proposta, o jovem parlamentar sustenta que, em situa\u00e7\u00f5es de <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">crise<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">s<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"> pol\u00edtica<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">s<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">, <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">e<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">con\u00f4mica<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">s<\/span><\/span><span medium;\">is (e que provoquem clamor popular desfavor\u00e1vel ao mandat\u00e1rio)<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">, <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">o governante <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">poder\u00e1 ser substitu\u00eddo pela vontade soberana dos seus governados sem maiores traumas <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">para as institui\u00e7\u00f5es republicanas. Assim, caso <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">o chefe do <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">E<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">xecutivo perca <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">a <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">legitimidade <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">para exercer o governo, <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">a Constitui\u00e7\u00e3o <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Federal passa a <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">autorizar a sua substitui\u00e7\u00e3o sem <\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">ruptura da normalidade democr\u00e1tica<\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Dessa forma, a substitui\u00e7\u00e3o do chefe do Executivo n\u00e3o se dar\u00e1 mais somente em decorr\u00eancia da pr\u00e1tica de crimes comuns ou de responsabilidade, como ocorre hodiernamente. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\">Em suma, sobrevindo a perda da confian\u00e7a depositada pelos eleitores em rela\u00e7\u00e3o ao governante, t\u00eam-se presentes as condi\u00e7\u00f5es para que o afastamento se d\u00ea em decorr\u00eancia da mais importante express\u00e3o do poder pol\u00edtico: a vontade do povo, materializada, no caso concreto, em uma consulta
