\u00a0O ministro Marcelo Ribeiro, do Tribunal Superior Eleitoral (TSE), concedeu medida liminar na noite de ter\u00e7a-feira (29) para suspender a decis\u00e3o do Tribunal Regional Eleitoral do Rio de Janeiro (TRE-RJ) que condenou Anthony Garotinho por abuso do poder econ\u00f4mico e uso indevido dos meios de comunica\u00e7\u00e3o e o considerou ineleg\u00edvel por tr\u00eas anos.<\/p>\n

A medida urgente foi deferida para garantir o registro de Garotinho como candidato ao Governo do Rio de Janeiro.<\/p>\n

A decis\u00e3o foi fundamentada numa das modifica\u00e7\u00f5es mais importantes introduzidas pela Lei da Ficha Limpa (Lei Complementar n\u00ba 135\/10).<\/p>\n

Com efeito, a LC n\u00ba 64\/90, alterada pela LC n\u00ba 135\/2010, estabelece que compete ao TSE suspender a inelegibilidade declarada por Tribunal Regional.<\/p>\n

\u00c9 o que se infere do teor do novel art. 26-C da LC n\u00ba 64\/90, que assim disp\u00f5e:<\/p>\n

Art.26-C. O \u00f3rg\u00e3o colegiado do tribunal ao qual couber a aprecia\u00e7\u00e3o do recurso contra as decis\u00f5es colegiadas a que se referem as al\u00edneas d, e, h, j, l e n do inciso I do art. 1\u00ba poder\u00e1, em car\u00e1ter cautelar, suspender a inelegibilidade sempre que existir plausibilidade da pretens\u00e3o recursal e desde que a provid\u00eancia tenha sido expressamente requerida, sob pena de preclus\u00e3o, por ocasi\u00e3o da interposi\u00e7\u00e3o do recurso.<\/p>\n

Assim, um pol\u00edtico condenado em decis\u00e3o judicial colegiada poder\u00e1 obter o registro da sua candidatura se ajuizar recurso perante um tribunal superior e o tribunal conceder efeito suspensivo a esse recurso, o que acarreta a suspens\u00e3o da causa de inelegibilidade.<\/p>\n

Todavia, essa manobra representa uma faca de dois gumes.<\/p>\n

\u00c9 que, deferido o efeito suspensivo, o julgamento do recurso ter\u00e1 prioridade sobre todos os demais processos (\u00e0 exce\u00e7\u00e3o dos feitos de mandado de seguran\u00e7a e de habeas corpus), o que resulta em um julgamento mais c\u00e9lere.<\/p>\n","protected":false},"excerpt":{"rendered":"
