Se o presidente Bolsonaro se reeleger em 2022 e ocupar o cargo at\u00e9 2026, Eduardo s\u00f3 poder\u00e1 concorrer a partir da elei\u00e7\u00e3o municipal de 2028.<\/strong><\/p>\n\n\n\n<p><strong>A \u00fanica alternativa para que Eduardo Bolsonaro possa se candidatar antes de 2028 \u00e9 que Jair Bolsonaro renuncie \u00e0 Presid\u00eancia pelo menos seis meses antes do pleito de 2022 ou 2026, conforme determina a Constitui\u00e7\u00e3o Federal.<\/strong><\/p>\n\n\n\n<p><strong>O instituto da inelegibilidade por parentesco (inelegibilidade reflexa) tem previs\u00e3o no artigo 14, \u00a7 7\u00ba da CF: \u201cs\u00e3o ineleg\u00edveis, no territ\u00f3rio de jurisdi\u00e7\u00e3o do titular, o c\u00f4njuge e os parentes consangu\u00edneos ou afins, at\u00e9 o segundo grau ou por ado\u00e7\u00e3o, do presidente da Rep\u00fablica, de governador de Estado, de prefeito ou de quem os haja substitu\u00eddo dentro dos seis meses anteriores ao pleito, salvo se j\u00e1 titular de mandato eletivo e candidato \u00e0 reelei\u00e7\u00e3o\u201d<\/strong>.<\/p>\n\n\n\n<p><strong>Desse modo, os parentes do prefeito n\u00e3o poder\u00e3o concorrer a vereador ou prefeito no \u00e2mbito do mesmo munic\u00edpio; os parentes do governador n\u00e3o poder\u00e3o candidatar-se a qualquer cargo no territ\u00f3rio do respectivo estado e os parentes do presidente da Rep\u00fablica n\u00e3o podem pleitear elei\u00e7\u00e3o para qualquer cargo no pa\u00eds.<\/strong><\/p>\n\n\n\n<p><strong>O prop\u00f3sito do mandamento constitucional \u00e9 evitar que o chefe do Poder Executivo utilize o prest\u00edgio e a influ\u00eancia do seu cargo para beneficiar os parentes, em detrimento da isonomia que deve nortear todo o processo eleitoral.<\/strong><\/p>\n\n\n\n<p><strong>Assim, previne-se a forma\u00e7\u00e3o de oligarquias, o continu\u00edsmo e a pereniza\u00e7\u00e3o de um mesmo grupo familiar na chefia do Executivo, em homenagem ao princ\u00edpio republicano, fundado nos postulados da eletividade, altern\u00e2ncia do poder pol\u00edtico e temporariedade dos mandatos.<\/strong><\/p>\n\n\n\n<p><strong>A ressalva constante da parte final do mencionado \u00a77\u00ba mant\u00e9m a elegibilidade dos parentes que sejam detentores de mandato eletivo e desejem concorrer \u00e0 reelei\u00e7\u00e3o.
